Court wins Harun over Cedrus Investment Ltd

JAKARTA – South Jakarta District Court rejected Wednsday a lawsuit submitted by Hong Kong- based Cedrus Investment Ltd owned by Lebanese businessman Rani T Jarkas against Indonesian businessman Harun Abidin and other three parties related to an investment dispute which now under Indonesian police investigation.

The other three parties are The Indonesian Central Securities Depository (KSEI), Standard Chartered, and Indonesian police’s Criminal Investigation Agency (Bareskrim).

The case started when Harun Abidin reported Cedrus to police for allegedly embezlement of shares of his company PT Cakra Mineral invested in Cedrus Investment. The police then issued a request to KSEI to freeze the alleged shares, a move which later sued by Cedrus to the court.

The panel of judges in the decision of the case number 918 / Pdt.G / 2016 / PN.JKT.Sel, in its consideration said Harun’s report against Cedrus to the police was not against the law.

“What Mr. Harun has done is legitimate and had a legal basis,” said Mochamad Hendra Kusuma Jaya, Harun’s lawyer.

In addition, he said, the panel of judges considered that the request of the police to KSEI to freeze the shares aimed at preventing a greater losses from Harun Abidin’s side and also the investigation’s purpose.
“Police have a full authority for it,” he added.

Under the court’s decision, he asked the police to immediately investigate the case especially Cedrus owner Rani Jarkas whose whereabouts is unclear.
“He must be included in the list of wanted persons because he has been repeatedly absent from police summons,” he said. (*)
